These Terms of Use (“Terms”) contain important information about your legal rights and obligations as a user of our website, available at https://www.edcamp.ua (the “Website”), which contains information about the NGO “EdCamp Ukraine” and its activities. If you do not agree with these Terms, please do not continue to use the Website.

The Website is operated by Non-Governmental Organisation «EdCamp Ukraine» who we may refer to as NGO”EdCamp Ukraine”, “we” or “us”.

 

Our processing of personal data in connection with your access to and use of the Website is described in our Політики приватності.

Entire agreement

These Terms and any operating rules and policies posted on our Website, including Privacy Notice, constitute the entire legally binding agreement and understanding between NGO EdCamp Ukraine and our users (“you” or “user”), governing your use of the Website.

By using the Website you hereby declare and warrant that:

  1. You have read, understand, and agree to be legally bound by and to comply with these Terms in full
  2. You are at least 18 years old (or act with consent of parents or guardian)
  3. You have the appropriate authority to act on behalf of the legal entity
  4. You comply with all applicable laws and regulations.

EdCamp Ukraine activities

NGO “EdCamp Ukraine” holds training events for employees in the sphere of education. Such events take place at the national and regional levels in online and offline formats.

Please note that some events may be chargeable. You may find detailed information on the conditions, cost, and payment procedure, in the description of a particular event.

As a result of attending our events, you will receive from NGO “EdCamp Ukraine” a certificate of participation and, if desired, a certificate of advanced training after filling out the final reflection form. Learn more about EdCamp Ukraine’s strategy for standardization of advanced training programs and conditions for obtaining certificates by reading the Regulation “On the policy of standardization and certification of advanced training programs“.

EdCamp Ukraine Website

You can learn about NGO “EdCamp Ukraine” activities on the Website, follow current information about the events we organize, use a convenient search for filters, and register for participation.

We have a register of certificates of advanced training issued on the Website. It is possible to determine if a specific certificate was issued by defining its details in the search form.

You can view and respond to current vacancies on the Website and join our events as a volunteer or partner by submitting an online application form.

Through the Website, users can make charitable contributions in favor of NGO “EdCamp Ukraine”. We use them to implement statutory goals – to organize the events described above. You can pay a one-time fee or subscribe to monthly payments for a certain amount that can be canceled at any time on the Subscription Management page. You will receive a confirmation letter  with a payment link to Privat24, LiqPay, or your bank support service. Paid charitable contributions are non-refundable.

The third-party payment service provider (LiqPay) may provide payments through our Website. As soon as you follow the link to pay for the order, you must follow the rules of such a provider. We are not responsible for the processing of your personal data by such providers.

Content and Intellectual property

The Website is operated by NGO “EdCamp Ukraine”. All materials of the Website, including text, graphics, design, information, images, drawings, trademarks, logos, video, sounds, music, software, and other materials (collectively, the “Content”), as well as copyright and other intellectual property rights to such Content belong to NGO “EdCamp Ukraine” or are included in the Websites with the consent of the owner.

You are not allowed to use the Content or any of its elements in any way not provided for in these Terms without the prior written permission of NGO “EdCamp Ukraine” or owners of the Content.

Subject to your compliance with these Terms, NGO “EdCamp Ukraine” grants you a limited, non-exclusive, revocable, non-sublicensable, non-transferable license to:

  1. use the Website on your personal device(s) in the manner provided for in these Terms;
  2. access and view any Content made available in or through the Website for personal, non-commercial use only.

NGO “EdCamp Ukraine” may periodically update and modify the functionality of the Website. The license set forth here applies to any updates and modifications unless the NGO “EdCamp Ukraine” states otherwise.

You are not allowed to reproduce, publish, transmit, distribute, modify, create derivative works or otherwise use the Content for commercial or illegal purposes without our prior written permission. You agree not to change or delete any ownership notices from materials downloaded or printed from the Website.

Third-party services and websites

Some features of the Website, for example, registration on events, goods purchases, watching online events and video, donating, may be made available or accessed in connection with third-party services that we do not control.

We are not responsible for the content and services offered through those or any other websites and services, as well as for any losses, damages or other liabilities incurred as a result of your use of any third-party websites or services.

You acknowledge that different terms of service and privacy policies may apply to your use of third-party websites and services. NGO “EdCamp Ukraine” shall not be held responsible for personal data processed by third-party websites and services.

Disclaimer of warranties

This Website is provided to you “as is”. Other than as expressly set out in these Terms or any of our policies on the Website, NGO “EdCamp Ukraine” disclaims all warranties regarding the Website, its features and content to the fullest extent permitted by law including without restrictions, guarantees of merchantability, fitness for a particular purpose and non-infringement of intellectual property rights of third parties or other rights.

NGO “EdCamp Ukraine” does not provide any guarantees regarding the accuracy, relevance, and suitability for using information that can be obtained through the Website or attending our events.

We are not making any promises of any kind, including the Website’s and content’s accuracy, usefulness, reliability, and correct operation. NGO “EdCamp Ukraine” does not guarantee that the Website will be uninterrupted or secure, that any defects will be corrected, or that the Website is free of viruses or anything else harmful.

Limitation of liability

NGO “EdCamp Ukraine” is not responsible if any information, materials, content available through the Website are inaccurate or incomplete and for typographical errors or deficiencies in the text or other materials.

In no event shall NGO “EdCamp Ukraine”, its employees or agents be liable for direct, indirect, incidental, special, punitive or consequential damages, including lost profits, data loss or property damage related to any use or inability to use the Website or Content; for damage resulting from the use of information or services obtained through the Website, and as a result of any damages, caused by mistakes, omissions, interruptions, defects, even if NGO “EdCamp Ukraine” has been advised of the possibility of such damages.

The foregoing limitations of liability and disclaimer of warranties do not apply to the extent prohibited by law.

Indemnification

You agree to defend, indemnify and hold harmless NGO “EdCamp Ukraine”, our partners, employees, contractors and agents from and against any and all claims, responsibility, damages, losses, and expenses, including reasonable legal and accounting expenses, arising from:

  1. any breach by you of any of these Terms;
  2. your use/misuse of the Website, Content or features available through the Website;
  3. a violation by you of applicable law, third-party’s intellectual property or other rights, any agreement or terms with a third party to which you are subject.

You also agree to reimburse NGO “EdCamp Ukraine” for any damage, loss, cost or expense incurred (including fees or costs of attorneys, accountants, professional advisors, and other experts incurred in connection with the defense or settlement of the foregoing) because of your use of the Website for any unlawful or prohibited purpose.

Applicable law and jurisdiction

These Terms shall be exclusively governed by and construed in accordance with the laws of Ukraine.

If any material in the Website, or your use of the Website is contrary to the laws of the place where you are when you access it, the Website is not intended for you, and we ask you not to use it. You are responsible for informing yourself of the laws of your jurisdiction and complying with them.

Any dispute, conflict, claim or controversy directly or indirectly arising out of or in connection with the Website or these Terms, including, those relating to its validity, its construction or its enforceability shall be resolved by means of amicable negotiations directly with NGO “EdCamp Ukraine” team in accordance with the principles of good faith and cooperation. If the consensus may not be reached by the negotiations, the dispute shall be settled exclusively in the state courts of Ukraine, subject to its jurisdiction rules, with the applicable substantive law of Ukraine.

All claims shall be brought within one (1) year after the claim arises, except to the extent a longer period is required by applicable law.

Electronic communications

By using the Website and providing us with your contact information, you understand and agree that we may send you the electronic communications regarding, without limitation,

  1. updates of the Website and the Terms;
  2. information or materials relating to your use of the Website, in particular, notifications about applications submitted for participation in our events or about joining our activities, tips, and helpful information about the use of the Website.

Other terms

NGO “EdCamp Ukraine” has the right to monitor the compliance of your use of the Website and the requirements of these Terms. In the event of violations, we may revoke or stop providing you with access to the Website. You may terminate this Agreement between you and NGO “EdCamp Ukraine” by ceasing your use of the Website.

At any time, at our sole discretion, we reserve the right to modify, suspend or terminate the Website, Content, features, or suggestions, with or without notice; and / or offer or cancel opportunities for some or all users of the Website. You agree that we are not liable to you or to any third party in such a case.

If any provision of these Terms is determined to be unlawful, void or unenforceable, the remaining provisions of these Terms will continue to be fully valid and enforceable.

We may transfer our rights and obligations under these Terms to a third party, but this will not affect your rights or our obligations under these Terms.
A printed version of these Terms shall be admissible in judicial or administrative proceedings based on or relating to use of the Website to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

We reserve the right, at any time at our sole discretion, to modify these Terms. In case of material changes affecting your rights or your use of the Website, we’ll notify you prior to the changes’ effective date by sending you an email.
